Welcome to the web site (the "Site") of HealthPoint Oriental Medicine, LLC ("HealthPoint” "we,” "us" and/or "our"). This privacy policy (the "Privacy Policy") sets forth our policy with respect to the Personally Identifiable Information (“PII,”) including your health related information that you may choose to provide ("Personal Health Information,” “PHI") and other information that is collected from visitors to the Site ("you,” "your").

HealthPoint Oriental Medicine, LLC (hereinafter “HealthPoint”) values its customers and respects their privacy. HealthPoint’s current policy regarding data privacy (and including www.healthpointclinic.org) is to:

  • To not sell, rent, or trade any clinical or health insurance specific information provided to HealthPoint by a client or patient, or to HealthPoint by any third party on a client or patient’s behalf.

  • To take reasonable steps under our available resources to limit access of client or patient data only to those HealthPoint staff, contractors, agents, or other persons who have a legitimate reason to review and/or use such data on behalf of the client or patient. Your Health Information May Be Used and/or Disclosed for the Following Purposes:
  1. During the course of our relationship with you we will likely use and disclose health information about you for treatment, payment, and healthcare operations.

  2. To provide, coordinate and manage healthcare treatment or service. We may disclose health information about you to health professionals who are involved in your care.

  3. To receive payment from you, or an insurance company or other third party for services that we provide.

  4. For certain activities related to business functions of this office.

  5. To contact you as a reminder that you have an appointment for purposes of rescheduling your appointment.

  6. Unless you object, we may disclose your information directly as it relates to such persons’ involvement in your health care or payment for such health care.

  7. To inform you about recommended possible treatment aftercare options that will benefit you.

  8. For other special situations such as public health activities, for averting a serious threat to health or safety, or for workers’ compensation purposes, in which case we will use only the information that is minimally necessary.

  9. We will disclose minimally necessary health information about you when required to do so by federal, state, or local laws.

  10. We will not disclose your health information to any person or organization without your signed consent, except where we may be required to do so by federal, state, or local law.

What Kind of Information Does HealthPoint Collect?

The information collected may be considered Personally Identifiable Information (PII) and Personal Health Information (PHI). HealthPoint collects PII and PHI necessary to complete an online inquiry about our services or an actual online service request. Such PII and/or PHI may include your demographic information, emergency contact information, contact information for insurance companies, managed care organizations, or other third parties responsible for all or part of the cost of services rendered (or to be rendered) to you by HealthPoint.

HealthPoint collects PHI or PII in the Online Forms section of the Site or at other times or methods by which you initially contact us, but only with your express permission, for the purpose of communicating with you about appointment reminders, newsletters, etc. While certain information may be necessary to obtain in order to submit insurance claims on your behalf or to communicate with your physician or other of your health care providers, you may opt-out of certain non-critical communications from HealthPoint at any time.

Why is PII and PHI Collected?

PII and PHI is collected for any of the following purposes:
    1. To respond to your questions or request regarding our services, credentials, pricing, and operations.

    2. To gather basic clinical information, and only that which you willingly provide, in order to, as much as possible, ascertain the nature of your health concern ahead of your initial appointment so that we can be ready to best serve you with minimal delay.

    3. To communicate with other health care providers who may have, at your request, referred you to us or to whom we may recommend referring you and/or to share the results of medical exams, tests, and/or procedures or consultative notes.

    4. To obtain basic insurance information from you in advance of or subsequent to your initial appointment in order to determine whether services that we provide to you are covered under your policy.

    5. To accurately and properly submit one or more claims to your insurance company or other third parties so that charges for services rendered to you at HealthPoint can be properly considered for payment under your policy or policies and, if appropriate, paid on your behalf.
You may always choose not to provide PII and PHI. However, should you refuse to provide PII and PHI, HealthPoint may not be able to perform certain of the above referenced functions should they be necessary or requested by you.

How Does HealthPoint Use PII and PHI?

At or prior to your initial appointment at HealthPoint, we request and/or collect from you PII and PHI as described above. PII and PHI are used by HealthPoint to establish or update a clinical chart which serves as your health record and chronological record of services received at HealthPoint.

HealthPoint uses PII to send reminder e-mails regarding your appointments at HealthPoint, to notify you regarding HealthPoint services or products, to notify you regarding changes in law or regulation that may affect the services we provide, to alert you regarding changes to your relevant health or auto insurance coverage, or to communicate to or with you regarding any other important information. HealthPoint will always notify you regarding your ability to opt-out or unsubscribe regarding non-essential communications.

Further, HealthPoint may provide limited PII (e.g., e-mail addresses) to one or more reputable third parties who forward communications to customers on our behalf and who may also aggregate non-personal statistical information regarding Site traffic patterns, and related Site information.

When any PHI or PII is collected by or sent to HealthPoint through our Site the information is directed only to the person at HealthPoint best suited to process the request, answer questions, or resolve concerns. HealthPoint may contact you via phone, U.S. Mail or e-mail if we need to clarify information submitted by you or if we feel the requested information is best conveyed via phone, U.S. Mail or email.

What Information Does HealthPoint Share with Third Parties?

As stated previously, HealthPoint does not sell or rent any online information provided by you to third parties, except for the purposes of coordinating the health care services provided to you or for the purpose of submitting claims for review and, where appropriate, payment on your behalf. Beyond that, HealthPoint will only release your account information (and only the most limited information necessary) to a third party when HPOM believes, in good faith, that such release is reasonably necessary to:
  1. comply with law

  2. enforce or apply the terms of any agreements between you and HealthPoint

  3. protect the rights, property or safety of HealthPoint, its employees, or its customers.

How Can I Opt-Out of Collection of PII and PHI?

To opt-out of providing PHI or PII while using www.healthpointclinic.org, contact HealthPoint.

Please remember that without even very limited PHI or PII, HealthPoint will not be able to contact you to resolve questions or issues.

How Does HealthPoint Manage Updates, Changes, Deletions or Removal of PII and PHI?
A.
You have the right to request that HealthPoint update or change PHI or PII if you believe the PHI or PII is inaccurate or incorrect. A request to update or change must be made in writing to HealthPoint at info@healthpointclinic.org, or according to the contact information set forth at the end of this privacy polcy.

HealthPoint may deny your update or change request under the following circumstances:
  • The PHI or PII is accurate and complete.

  • The request for update or change was made verbally.

  • The request does not state a reason for the amendment
As a provider of health care services, HealthPoint is obligated to retain health history and medical record information according to federal and/or state statutory requirements. PII and PHI are retained accordingly.

How Can I Remove Information from Phone, e-mail, and U.S. Mail Lists?
A.
HealthPoint typically includes “unsubscribe” or similar means by which you can immediately opt-out of most communications we send via e-mail. In addition, if your preference is to not receive information from HealthPoint, please contact us or call us at 651-698-1404.

Unsubscribe requests may take up to 30 days to process once received. After removal from an email or mail list HealthPoint will maintain name(s) in an “unsubscribed” file to ensure the request is honored.

How Does HealthPoint Protect the Privacy of Minors?
A.
HealthPoint is concerned about the safety of children when they use the Internet. If HealthPoint becomes aware that a subscriber is under the age of 18 and has provided PHI or PII without prior verifiable parental consent, HealthPoint will remove his or her personally identifiable registration information from our files.

In order to maintain the confidentiality of a customer’s PII and PHI HealthPoint enforces strict company-wide policies regarding privacy, security, and confidentiality on staff members as well as www.healthpointclinic.org. HPOM limits access to your PII and PHI to only a very small number of appropriate HealthPoint staff members. HealthPoint adheres to and complies with The Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy and Security Rules (http://www.hhs.gov/ocr/privacy/hipaa/understanding/index.html).

What is HealthPoint's Advertising Policy Regarding its Website?

HealthPoint does not allow third-party advertising on its web-site.

A.
HealthPoint links from its Site to other web-sites where we believe the information supports our mission and/or public service to the individuals and communities that we serve. No PII or PHI is shared with these sites. The appropriateness of links to external sites is reviewed periodically.
